New BUI level in Oklahoma goes into effect

A new state law lowering the legal blood alcohol limit for boat operators from 0.10 to 0.08 percent will have its first major run during the Memorial Day weekend, one of the busiest holidays on the state's waterways.

Lt. Kurt McKean, Oklahoma Highway Patrol marine enforcement division supervisor, said it does not matter whether a boat is anchored or in motion. Someone who has immediate access to a boat can be cited or arrested for boating under the influence.

“If they're anchored it's the same as being in a parked car with keys in the ignition,” McKean said.
